TERMS AND CONDITIONS
Our services and products are provided subject to the following Terms and Conditions. By using www.perkieprints.com, you consent to these Terms and Conditions.
Disclaimer: We try to be as eco-friendly as possible, so a lot of our shipping materials are recycled. Order processing times may vary. You do receive an automated confirmation email with your order number and the details of your order. Our customer care team will also contact you via email within 36 business hours of receiving your order and give you your expected print preview delivery date or set you up with our photo selection specialist. The delivery date to receive your Perkie Print is given once we finalize all photos in your order and receive payment in full. Delivery date can range from 1 to 4 weeks depending on the volume of orders and communication speed. Although you submit photos via the website, if the photo submitted is lower than the quality we need, an email confirmation from you is needed to proceed with creating your Perkie Print. If we do not receive a response from you via email, we send email reminders, but ultimately cancel the order and issue you a store credit for the full amount of your order.
We will email you a preview of your print to receive your final approval before sending to print and frame. We will wait up to one month to receive final approval with you before we send to print. If a month has gone by, we reserve the right to cancel your order of the shippable items, and only charge you for the digital file. Due to the nature of custom art, once we have created your Custom Perkie print, we cannot offer a full refund. We can only refund you down to the price of our digital file. If we choose to do this, we will send over the digital file in place of the shippable item. If ,after a month, you get the digital file, and choose to still want the shippable item you ordered, we will send over a new invoice for the shippable item.
Because we work closely with you to choose the right photo to create the perfect print, we do not accept requests for new photos or prints after sending the preview of your print. We will, however, work with you on sizing, scale, and placement, if needed. There is an additional fee to change to a new photo, after we have sent your initial print previews. All Sales are Final.
Prices do not include shipping. Customer pays shipping. Shipping speeds provided via the carrier at checkout are not indicative of the delivery date & speed of the production of your item from Perkie Prints.

2. TERMS OF USE
Website Access:
Perkie Prints is a registered trademark. We reserve the right to immediately remove your account and access to www.perkieprints.com including any products or services offered through the site, without refund, if you are caught misusing our website, services, or products.
Trademark Rights:
The name “Perkie Prints” or any variation that is confusingly similar and the associated marks, phrases, logos, and designs that we use in connection with our services, are trademarks, service marks, or trade dress of Perkie Prints in the US and other countries. You may not use this Trademark without our express, written permission.
Intellectual Property Rights and User Submissions:

User Representations Regarding Submitted Materials: By submitting any photograph or material to Perkie Prints, you represent and warrant that you own all rights to the submitted materials or have obtained appropriate rights and permissions from the rightful owner(s) to use and submit such materials. You agree to provide evidence of such rights or permissions upon our request.

Release of Liability: You agree to indemnify, defend, and hold harmless Perkie Prints, its officers, directors, employees, agents, licensors, suppliers, and any third-party information providers to the service from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of this agreement by you or any wrongful use of the submitted materials that infringes on the rights of any third party.

Grant of Rights to Perkie Prints: By uploading, posting, or submitting materials to Perkie Prints, you grant us a perpetual, non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such materials (in whole or part) and/or to incorporate it in other works in any form, media, or technology now known or later developed for the full term of any rights that may exist in such content. You also grant Perkie Prints the right to claim ownership of the artwork created from such materials as proprietary works and to utilize such artwork for any promotional, business development, or marketing purposes in perpetuity.

Financial Gain and Future Use: You hereby waive any rights to financial compensation from the use, sale, or distribution of the artwork created by Perkie Prints from the submitted materials, regardless of the form or media in which they are used. You acknowledge that Perkie Prints retains the right to use such artwork for any future products, promotions, or commercial purposes without any obligation to provide compensation or recognition to you.
- Acknowledgment of Perkie Prints Ownership: You acknowledge that all custom artwork created by Perkie Prints from submitted materials becomes the exclusive property of Perkie Prints, with Perkie Prints holding all rights, titles, and interests in the artwork, including any and all intellectual property rights therein.
Materials you submit to PerkiePrints.com:
You shall not upload, post or otherwise make available on the this site any artwork, photos, or other materials (collectively “Materials”) protected by copyright, trademark, or other proprietary right without the express written permission of the owner of the Materials, and the burden of determining that any Materials are not so protected rests entirely with you. You shall be liable for any damage resulting from any infringement of copyrights, trademarks, or other proprietary rights, or any other harm resulting from such a submission. We reserve the right to remove or reject any user submitted materials.
Your Account:
You must be 18 or older to use our services and/or buy from our site. Minors under 18 and at least 13 years of age are only permitted to use our Services through an account owned by a parent or legal guardian with their appropriate permission and under their direct supervision. Children under 13 are not permitted to use Perkie Prints or services.
You consent to receive communications from us by e-mail, which may include promotion or marketing information. You have the option to opt out or unsubscribe at any time. If you use this website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion. You may use this site and our services for lawful purposes only. You agree to be financially responsible for all purchases made by you or someone acting on your behalf through this site. You agree to use this site and to purchase services or products through this site for legitimate purposes only. You agree not to steal, in any manner, any page of this site or to reverse engineer or attempt to obtain the source code of the services provided. You further agree to not purchase products or use our services for commercial gain. Meaning, you cannot re-sell our products for a commercial profit. You agree not to interfere with or try to disrupt our services, for example by distributing a virus or other harmful computer code.
Suggestions and Ideas
Visitors may submit suggestions, ideas or questions to hello@perkieprints.com. By doing so, you acknowledge that we will be free to use, disclose, reproduce, modify, license, transfer and exploit any suggestions or ideas in any manner.
Limitation of Liability:
We do not accept responsibility that this site, its servers, or e-mail sent from the website is free of viruses or other harmful components. You expressly understand and agree that we will not be liable for damages of any kind arising from the use of this site.
3. TERMS OF SALE:
These Terms of Sale apply to all offers and orders made by Perkie Prints, all purchases and orders placed by you, and all agreements concluded between buyer and seller in relation to the products and services offered on this site.
Cancellation:
All orders are custom made to customer’s specifications. Cancellations are only accepted within twenty four (24) hours from the time we send our initial email to you that contains the turnaround time. No cancellations are accepted after that time frame.
All sales are final. No returns or refunds. We are committed to quality products and your satisfaction is very important to us. We work closely with you before we start the print, and make sure you are fully aware of the quality of the print you will receive.
We understand that at times things are not handled with care during shipment, so should anything arrive broken, please email us at hello@perkieprint.com as soon as you receive your damaged order. Please provide us with picture of the damage and we will work with you as fast as we can to resolve the issue.
Pricing
Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service
Acceptance of Order
We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
Product Descriptions
We attempt to describe and display our products as accurately as possible. However, we cannot guarantee that the descriptions will be completely current or error-free. This includes, but is not limited to the color, texture, or size.
